5. The Authority may, on its own initiative, conduct an investigation into any matter relating to the application of this chapter, including into the tendering or awarding process for a public contract or the performance of such a contract.
To that end, the Authority is vested with the powers and immunity of commissioners appointed under the Act respecting public inquiry commissions (chapter C-37), except the power to order imprisonment. When the Authority’s investigation concerns an ongoing tendering or awarding process, sections 48 and 49 of the Act respecting the Autorité des marchés publics (chapter A-33.2.1) and the second paragraph of section 50 of that Act apply, as the case may be, with the necessary modifications.
