48. The insurance contribution exigible in 2008 from a driver’s licence holder born in an odd-numbered year is the amount obtained by adjusting in accordance with section 45 the difference between the insurance contribution determined under paragraph 1 and the insurance contribution determined under paragraph 2:

(1)  that prescribed in section 12, before adjustment under section 45, according to the total number of demerit points used in calculating the insurance contribution exigible in 2007, in accordance with the Regulation respecting insurance contributions (O.C. 1422-91, 91-10-16);

(2)  that paid for the period between his birthday in 2008 and his birthday in 2009, under the Regulation respecting insurance contributions.

The insurance contribution paid under the first paragraph is subject to a refund in accordance with the rules set out in sections 37 to 41 by substituting, in those sections, the insurance contribution paid under the first paragraph for the annual insurance contribution prescribed in section 12.
