CHAPTER I
INSURANCE CONTRIBUTION PAYABLE UPON REGISTRATION OF A ROAD VEHICLE FOR THE RIGHT TO OPERATE THE VEHICLE, AND RETENTION OF THAT RIGHT
DIVISION I
DEFINITIONS
1. In this chapter, “antique motor vehicle”, “bus engaged in the transportation of schoolchildren”, “commercial vehicle”, “equipment transport vehicle”, “farm motor vehicle”, “farm tractor”, “legal person”, “motor home”, “net weight or mass”, “passenger vehicle”, “private bus”, “public bus”, “snowblower”, “snowmobile”, “special mobile snow equipment”, “trailer”, “truck”, and “vehicle engaged in the transportation of schoolchildren” have the same meaning as defined in the Regulation respecting road vehicle registration (chapter C-24.2, r. 29) and “moped”, “motorcycle”, “road vehicle”, “taxi”, “tool vehicle” and “tow truck” have the same meaning as defined in the Highway Safety Code (chapter C-24.2).

DIVISION II
ANNUAL INSURANCE CONTRIBUTION PAYABLE TO RETAIN THE RIGHT TO OPERATE A ROAD VEHICLE FOR THE YEARS 2008 THROUGH 2010
2. Where payment of the insurance contribution is due in 2008, 2009 or 2010, the annual insurance contribution payable to retain the right to operate a road vehicle is the amount obtained by adjusting under section 45 the annual insurance contribution determined as follows:
(1)  for a motor home with a net weight of 3,000 kg or less or for a passenger vehicle, belonging to a natural person and mainly used for personal purposes:
(a)  where payment of the insurance contribution is due in 2008, the amount of the annual insurance contribution is $109.16 ($109.17 as adjusted);
(b)  where payment of the insurance contribution is due in 2009, the amount of the annual insurance contribution is $111.78 ($111.92 as adjusted);
(c)  where payment of the insurance contribution is due in 2010, the amount of the annual insurance contribution is $112.90 ($112.84 as adjusted);
(2)  for a passenger vehicle covered by section 98 or 99 of the Regulation respecting road vehicle registration (chapter C-24.2, r. 29):
(a)  where payment of the insurance contribution is due in 2008, the amount of the annual insurance contribution is $108.82 ($109 as adjusted);
(b)  where payment of the insurance contribution is due in 2009, the amount of the annual insurance contribution is $111.43 ($111 as adjusted);
(c)  where payment of the insurance contribution is due in 2010, the amount of the annual insurance contribution is $112.54 ($113 as adjusted);
(3)  in the case of a motorcycle whose make and model, and the first 11 characters of the vehicle identification number, other than the ninth, which are listed in Schedule I and for motorcycles whose first 6 vehicle identification number characters are “2SAAQ4”, that shown in the following table:

(g)  a tow truck having a net weight of 3,000 kg or less;
(h)  an ambulance and a hearse;
(i)  a tow truck having a net weight over 3,000 kg that is used solely for the towing or moving of not more than 2 road vehicles;
(j)  an equipment transport vehicle;
(7)  for a taxi:

DIVISION III
ANNUAL INSURANCE CONTRIBUTION TO RETAIN THE RIGHT TO OPERATE A ROAD VEHICLE FOR THE YEARS AFTER 2010
3. Where payment of the insurance contribution is due after 2010, the annual insurance contribution to retain the right to operate a road vehicle is the amount of the insurance contribution obtained by adjusting, in accordance with section 45, the annual insurance contribution for the preceding year exigible for such a vehicle, before adjustment under section 45, indexed on 1 January of the payment due year, in accordance with sections 42 and 43.

DIVISION IV
EXEMPTION OF PAYMENT OF THE INSURANCE CONTRIBUTION TO RETAIN THE RIGHT TO OPERATE A ROAD VEHICLE
4. The owners of the following road vehicles are exempted from the obligation of paying the insurance contribution payable to retain the right to operate these vehicles:
(1)  a discarded vehicle;
(2)  a vehicle taken back from its long-term lessee by the lessor;
(3)  a vehicle acquired through repossession;
(4)  a vehicle acquired by an insurer from his policyholder following a declaration of total loss of that vehicle or following its theft;
(5)  a vehicle in the possession of a bankruptcy trustee;
(6)  a vehicle covered by any of sections 139 to 142 of the Regulation respecting road vehicle registration (chapter C-24.2, r. 29);
(7)  a trailer.

DIVISION V
INSURANCE CONTRIBUTION PAYABLE UPON REGISTRATION OF A ROAD VEHICLE AND FOR THE RIGHT TO OPERATE THE VEHICLE
5. The calculation of the insurance contribution payable upon registration of a road vehicle and for the right to operate the vehicle is done by applying the rules of calculation of the sums payable upon registration of a road vehicle and for the right to operate the vehicle specified in the Regulation respecting road vehicle registration (chapter C-24.2, r. 29) by replacing the respective annual and monthly sums covered by these rules by the annual insurance contribution specified in sections 2 and 3, before adjustment under section 45, and the monthly insurance contribution specified in section 6. The amount resulting from the calculation is then adjusted in accordance with section 45.

6. For the purposes of vehicle registration and for the right to operate a road vehicle, the monthly insurance contribution is the quotient obtained in dividing by 12 the annual insurance contribution payable to operate the vehicle during the current year, before adjustment under section 45. However, where a vehicle owner renounces the right to operate his vehicle within 4 months of the end of period during which operation of that vehicle is authorized, and he obtains the right to put the vehicle back into operation before that date, the annual insurance contribution is that in effect on the date of expiry before renunciation of the right of vehicle operation.

7. Notwithstanding section 5, the insurance contribution payable upon registration of a trailer and for the right to use this vehicle on a public roadway is the amount obtained by adjusting, in accordance with section 45, the amount of $11.92.

DIVISION VI
INSURANCE CONTRIBUTION PAYABLE UPON TEMPORARY REGISTRATION OF A ROAD VEHICLE AND FOR THE RIGHT TO TEMPORARILY OPERATE THE VEHICLE
8. The insurance contribution payable upon temporarily registration of a road vehicle and for the right to temporarily operate it under section 26 of the Regulation respecting road vehicle registration (chapter C-24.2, r. 29) is $3.67, in accordance with section 45.

9. The insurance contribution payable upon temporary registration of a road vehicle and for the right to temporarily operate it under one of sections 30 to 41, 44 and 45 of the Regulation respecting road vehicle registration (chapter C-24.2, r. 29), is $1.83, in accordance with section 45.

DIVISION VII
INSURANCE CONTRIBUTION EXIGIBLE AFTER THE PAYMENT DUE DATE
10. The cases and conditions that authorize the requirement to pay the insurance contribution past the due date to retain the right of vehicle operation follow the rules set out by the Regulation respecting road vehicle registration (chapter C-24.2, r. 29) concerning the cases and conditions that allow for claiming the fees payable to retain the right of vehicle operation beyond the due date, by respectively replacing the annual and monthly amounts covered under the rules by the annual insurance contribution set in sections 2 and 3, before adjustment under section 45, and the monthly insurance contribution specified in section 6. The amount resulting from the calculation is then adjusted in accordance with section 45.

DIVISION VIII
REFUND OF INSURANCE CONTRIBUTIONS
11. Refund of the insurance contribution paid upon registration of a road vehicle, for the right to operate the vehicle or retention of that right, is done under the rules f reimbursement specified by the Regulation respecting road vehicle registration (chapter C-24.2, r. 29), by respectively replacing the annual and monthly amounts provided under those rules by the annual insurance contribution under sections 2 and 3, before adjustment under section 45, and the monthly insurance contribution specified in section 6. The result of the calculation is then adjusted by applying section 45.

CHAPTER II
INSURANCE CONTRIBUTION PAYABLE BY A DRIVER’S LICENCE HOLDER OR APPLICANT
DIVISION I
DRIVER’S LICENCE HOLDER OR APPLICANT FOR A DRIVER’S LICENCE
12. The annual insurance contribution payable under the first paragraph of section 93.1 of the Highway Safety Code (chapter C-24.2) by the holder of a driver’s licence, except for a driver’s licence bearing only class 6D or 8, is the amount obtained by adjusting, in accordance with section 45, the annual insurance contribution determined as follows:
(1)  where payment of the insurance contribution is due in 2008, 2009 or in 2010, according to the total number of demerit points entered on the holder’s record within the 2 years preceding the 3-month period ending on the payment due date, as shown in the following table:

Insurance contribution for 2012:
(2)  where the insurance contribution is due after 2010, the amount of the annual insurance contribution is calculated by indexing on 1 January of the payment due year, in accordance with sections 42 and 43, the annual insurance contribution of the preceding year, before adjustment under section 45, in respect of the current classes of the holder of a driver’s licence and the total number of demerit points which were entered on the holder’s record over the 2 years preceding the 3-month payment period ending on the payment due date.

13. Where upon issue of a licence bearing one or more of classes 1 to 5, the insurance contribution exigible is the amount obtained by adjusting, in accordance with section 45, the product obtained by multiplying the monthly insurance contribution set under the second paragraph by the number of months, including parts of months, less 1, during which the holder is authorized to drive.
The monthly insurance contribution is the quotient obtained in dividing by 12 the annual insurance contribution set under section 12, before adjustment under section 45, according to the year of licence issue and classes and of the total number of demerit points entered on the holder’s record over a period of 2 years determined as follows:
(1)  to find the date of the end of the period, 15 months and one day are subtracted from the expiry date of the period during which the holder is authorized to drive;
(2)  to find the date of the start of the period, 24 months are subtracted from the date of the end obtained in accordance with subparagraph 1.

14. Where upon issue of a licence bearing one or more of classes 6A, 6B and 6C, the insurance contribution exigible is the amount obtained by adjusting, in accordance with section 45, the sum of contributions for the months, including parts of months, during which the holder is authorized to drive, except for the last month.
The insurance contribution for a month corresponds to the percentage, as determined below, of an amount equivalent to the annual insurance contribution set under section 12, before adjustment under section 45, on the basis of the year of licence issue and classes and of the total number of demerit points calculated according to the second paragraph of section 13:
(1)  January: 0.66%;
(2)  February: 0.67%;
(3)  March: 0.67%;
(4)  April: 8%;
(5)  May: 16%
(6)  June: 16%
(7)  July: 16%;
(8)  August: 16%;
(9)  September: 16%;
(10)  October: 8%;
(11)  November: 1%;
(12)  December: 1%.

15. Where upon issue of a licence bearing one or more of classes 1 to 5 and one or more of classes 6A, 6B and 6C, the insurance contribution exigible is the amount obtained by adjusting, in accordance with section 45, the sum of contributions as follows:
(1)  that calculated in accordance with section 13;
(2)  that calculated by adding together the insurance contributions for the months, including parts of months, during which the holder is authorized to drive, except for the last month. The insurance contribution for a month corresponds to the percentage, as determined under section 14, of an amount equivalent to the annual insurance contribution set under section 12, before adjustment under section 45, for the holder of a licence bearing one or more of classes 6A, 6B or 6C with no demerit point on record, according to the year of licence issue.

16. The insurance contribution upon issue of driver’s licence of class 8 only and that exigible under the first paragraph of section 93.1 of the Highway Safety Code (chapter C-24.2) from the holder of such licence is $10.09.

17. For purposes of the second paragraph of section 13, the second paragraph of section 14 and subparagraph 2 of the first paragraph of section 15, where a licence is cancelled within 3 months of the expiry date of the period during which the holder is authorized to drive and a new licence is issued before that date, the annual insurance contribution to be considered is the one set under section 12, before adjustment under section 45, according to the year of the holder’s next birthday.

18. The holder of an expired probationary licence who has not paid the insurance contribution covered by sections 13 to 15 for the first issue of a full-privilege driver’s licence nor advised the Société de l’assurance automobile du Québec prior to probationary licence expiry of his intention not to obtain the licence, must in order to obtain a full-privilege driver’s licence during the period during which payment of the insurance contribution was to be made, pay the insurance contribution.
A person covered by the first paragraph whose right to a licence was suspended for part of the period for which payment of the insurance contribution exigible was to have been made, must pay, on lifting of the suspension if that occurs during the period, the insurance contribution for that part of the period not covered by the suspension, to obtain a first full-privilege driver’s licence until the end of the period.

19. A driver’s licence holder who has not paid the annual insurance contribution under section 12 by the payment due date, and has not asked that his licence be cancelled or advised the Société prior to then of his intention not to renew the licence on that date, must pay the insurance contribution in order to again obtain authorization to drive until the end of the 12-month period for which payment of the insurance contribution must be made.
Where the annual insurance contribution was not paid by the due date, with respect to two 12-month periods and longer, only the insurance contribution for the 12-month period for which driving authorization is sought becomes exigible.

20. A driver’s licence holder who has not paid the annual insurance contribution under section 12 by the payment due date, and has not asked that his licence be cancelled or advised the Société prior to then of his intention not to renew the licence on that date, but whose licence was cancelled or revoked during the 12 months for which the annual insurance contribution was to be paid, must pay the annual insurance contribution upon licence cancellation or issue of a new licence where it is obtained during the period, for the portion of time preceding licence cancellation or revocation.
Where the annual insurance contribution was not paid by the due date, with respect to two 12-month periods and longer, only the period of 12 months during which licence cancellation or revocation occurred is considered and only the insurance contribution for the portion of time preceding licence cancellation or revocation becomes exigible.

21. A driver’s licence holder who has not paid the annual insurance contribution under section 12 by the payment due date, and has not asked that his licence be cancelled or advised the Société prior to then of his intention not to renew the licence on that date, but whose licence was suspended for part of the 12-month period for which payment of the annual insurance contribution was to have been made, must pay, on lifting of the suspension if that occurs during the period, the insurance contribution for that part of the period not covered by the suspension in order to again obtain authorization to drive until the end of the period.
Where the annual insurance contribution was not paid by the due date, with respect to two 12-month periods and longer, only the period of 12 months during which licence suspension was lifted is considered and the insurance contribution for that part of the period not covered by the suspension becomes exigible.

22. The holder of a licence that is suspended during a payment period of the amounts exigible under section 93.1 of the Highway Safety Code (chapter 24.2) is exempt from payment of the annual insurance contribution set under section 12 for the length of the suspension. Where the suspension is lifted during part of the period of 12 months for which payment of the insurance contribution was to be made, he must pay, on lifting of the suspension, the insurance contribution for that subsequent portion of time not covered by the suspension, in order to again obtain authorization to drive until the end of the period.

23. The holder of a licence that is suspended for part of a 12-month period for which payment of the annual insurance contribution set under section 12 was to be made and received an insurance contribution refund, must pay, on lifting of the suspension, the insurance contribution for that subsequent portion of time not covered by the suspension, in order to again obtain authorization to drive until the end of the period.

24. The insurance contribution exigible under the second paragraph of section 18 and sections 20 to 23 for a driver’s licence bearing one or more of classes 1 to 5 is the amount obtained by adjusting, in accordance with section 45, the product of the monthly insurance contribution set under the second and third paragraphs by the number of months, including parts of months, less one, comprised in the period for which an insurance contribution is exigible under those sections.
With respect to the insurance contribution exigible under sections 20 to 23, the monthly insurance contribution is the quotient obtained in dividing by 12 the annual insurance contribution prescribed by those sections, before adjustment under section 45.
With respect to the insurance contribution exigible under the second paragraph of section 18, the insurance contribution for a month is the quotient obtained in dividing by 12 the annual insurance contribution for the year of licence issue under section 12, before adjustment under section 45, according to licence class and the total number of demerit points calculated in accordance with the second paragraph of section 13.

25. The insurance contribution exigible under the second paragraph of section 18 and sections 20 to 23 for a driver’s licence bearing one or more of classes 6A, 6B and 6C is the amount obtained by adjusting, in accordance with section 45, the sum of insurance contributions, prescribed by the second and third paragraphs, for the months, including parts of months, comprised in the period for which an insurance contribution is exigible under those sections, except for the last month.
With respect to the insurance contribution exigible under sections 20 to 23, the insurance contribution for a month corresponds to the percentage, calculated under the second paragraph of section 14, of an amount equivalent to the annual insurance contribution set by those sections, before adjustment under section 45.
With respect to the insurance contribution exigible under the second paragraph of section 18, the insurance contribution for a month corresponds to the percentage, calculated under the second paragraph of section 14, of an amount equivalent to the annual insurance contribution for the year of licence issue under section 12, before adjustment under section 45, according to licence class and the total number of demerit points calculated in accordance with the second paragraph of section 13.

26. The insurance contribution exigible under the second paragraph of section 18 and sections 20 to 23 for a driver’s licence bearing one or more of classes 1 to 5 and one or more of classes 6A, 6B or 6C is the amount obtained by adjusting, in accordance with section 45, the sum of insurance contributions as follows:
(1)  that calculated under section 24, before adjustment under section 45;
(2)  that calculated by adding together the insurance contributions for the months, including parts of months, comprised in the period for which an insurance contribution is exigible under the second paragraph of section 18 and sections 20 to 23, except for the last month. The insurance contribution for a month is calculated by applying the percentage determined under section 14 to an amount equivalent to the annual insurance contribution for the payment due year, set under section 12, before adjustment under section 45, for the holder of a licence bearing one or more of classes 6A, 6B or 6C with no demerit point.

27. A person whose licence was revoked or whose right to obtain one was suspended under section 180 of the Highway Safety Code (chapter C-24.2) and who subsequently obtains a licence must then also pay an insurance contribution equivalent to the amount obtained by adjusting, in accordance with section 45, the sum of insurance contributions as follows:
(1)  that calculated under sections 13 to 15, before adjustment under section 45;
(2)  that shown in the following table, regarding the total occurrences of licence revocation and suspension of the right to a licence under section 180 of the Highway Safety Code entered on the person’s record during the 5 years preceding the issue date of the new licence:

28. In the case of a person whose previous licence was revoked and who did not seek a refund of part of the insurance contribution to which he was entitled, an amount is subtracted from the insurance contribution exigible for the issuance of a new licence according to the terms prescribed by the second paragraph.
From the amount of the insurance contribution exigible is subtracted the amount of insurance contribution paid for the number of months, excluding parts of months, for the revoked licence from the date of licence revocation and the expiry date of the period for which the insurance contribution was paid.
This section does not apply when a period of more than 3 years has elapsed between revocation of a preceding probationary licence and issue of a new driver’s licence.

The insurance contribution payable upon probationary licence issue by a person covered by section 92.0.1 of the Highway Safety Code (chapter C-24.2) or who is 23 years of age or older, is the amount obtained by adjusting, in accordance with section 45, the sum of insurance contributions as follows:
(1)  the insurance contribution determined as follows:
(a)  where the probationary licence bears one or more of classes 4A, 4B, 4C and 5, the insurance contribution exigible is the product obtained by multiplying the monthly insurance contribution by the number of months, including parts of months, less 1, during which the holder is authorized to drive; the monthly insurance contribution is the quotient obtained in dividing by 24 the insurance contribution set under paragraph 1 of section 30;
(b)  where the probationary licence bears one or more of classes 6A, 6B and 6C, the insurance contribution is the sum of insurance contributions for the months, including parts of months, during which the holder is authorized to drive, except for the last month; the insurance contribution for a month corresponds to the percentage, determined under section 14, of an amount equivalent to half of the insurance contribution, calculated under paragraph 1 of section 30;
(c)  where the probationary licence bears one or more of classes 4A, 4B, 4C and 5 and one or more of classes 6A, 6B and 6C, the insurance contribution is the sum of these insurance contributions:
i.  that calculated according to subparagraph a;
ii.  that calculated by adding together the contributions for the months, including parts of months, during which the holder is authorized to drive, except for the last month; the insurance contribution for a month is calculated by applying the percentage determined under section 14 to an amount equivalent to half of the insurance contribution, set under paragraph 1 of section 30, for the holder of a licence bearing one or more of classes 6A, 6B or 6C with no demerit point;
(2)  that calculated according to paragraph 2 of section 30.

32. In the case of a person whose probationary licence was revoked or the right to one suspended under section 180 of the Highway Safety Code (chapter C-24.2) and who subsequently obtains a new probationary licence, must pay upon issue of this new licence the insurance contribution equal to the amount obtained by adjusting, in accordance with section 45, the sum of insurance contributions as follows:
(1)  the insurance contribution determined as follows:
(a)  where the probationary licence bears one or more of classes 4A, 4B, 4C and 5, the insurance contribution is the product obtained by multiplying the monthly insurance contribution by the number of months, including parts of months, less 1, during which the holder is authorized to drive; the monthly insurance contribution is the quotient obtained in dividing by 24 the insurance contribution set as follows:
i.  where the year of probationary licence issue is 2008, 2009 or 2010, according to the year of initial probationary licence issue, its classes and total number of demerit points entered on the person’s record during the 2 years prior to the date of initial probationary licence issue as shown in the table under subparagraph a of paragraph 1 of section 30;
ii.  where the year of issue of a probationary licence is after 2010, the insurance contribution is set by indexing on 1 January of the year of issue in accordance with sections 42 and 43, the insurance contribution for the preceding year, before adjustment under section 45, according to the classes of the holder’s initial probationary licence and the total number of demerit points entered on the person’s record during the 2 years prior to the date of initial probationary licence issue;
(b)  where the probationary licence bears one or more of classes 6A, 6B and 6C, the insurance contribution is the sum of insurance contributions for the months, including parts of months, during which the holder is authorized to drive, except for the last month; the insurance contribution for a month corresponds to the percentage, determined under section 14, of an amount equivalent to half of the insurance contribution, calculated according to subparagraph a;
(c)  where the probationary licence bears one or more of classes 4A, 4B, 4C and 5, and one or more of classes 6A, 6B and 6C, the insurance contribution is the sum of insurance contributions as follows:
i.  that calculated according to subparagraph a;
ii.  that calculated by adding together the insurance contributions for the months, including parts of months, during which the holder is authorized to drive, except for the last month; the insurance contribution for a month corresponds to the percentage, as determined under section 14, of an amount equivalent to half of the insurance contribution calculated according to subparagraph a, for the holder of a licence bearing one or more of classes 6A, 6B or 6C with no demerit point;
(2)  that calculated according to paragraph 2 of section 30.
For the purposes of applying the first paragraph, where more than 5 years have elapsed between the start of the 2 years that should have entered into the calculation of demerit points and new probationary licence issue, another 2-year period must be determined for calculating points as follows:
(1)  for determining the date of the end of the new period of 2 years, 24 months are added to the date marking the end of the period of 2 years that was to be used;
(2)  for determining the date of the start of the new period of 2 years, 1 day is added to the date marking the end of the period of 2 years that was to be used;
(3)  the calculations prescribed in paragraphs 1 and 2 are repeated until the length of time from the start of the period of 2 years that must be used for calculating demerit points and issue of a new licence is less than 5 years.

33. The person whose probationary licence was cancelled at his request or revoked under section 187.1 of the Highway Safety Code (chapter C-24.2), who, subsequently to this cancellation or revocation, is issued a new probationary licence, must pay the insurance contribution calculated according to section 32 except for subparagraph 2 of the first paragraph.

34. In the case of a person whose previous probationary licence was revoked and who has not requested the refund of that portion of the insurance contribution to which he is entitled, an amount is subtracted from the insurance contribution payable for the issue of a new probationary licence according to the terms specified in the second paragraph.
From the insurance contribution due, an amount is subtracted corresponding to the insurance contribution paid for the revoked licence during the months, excluding parts of months, between the date of licence revocation and the date it would have expired.
The first paragraph does not apply when more than 3 years have elapsed between the revocation of the preceding licence and issuance of a new probationary licence.

DIVISION IV
RESTRICTED LICENCE APPLICANT
35. The insurance contribution payable upon the issue of a restricted licence covered by section 76 of the Highway Safety Code (chapter C-24.2) is the amount obtained by adjusting, in accordance with section 45, the product obtained by multiplying the monthly insurance contribution set under the second paragraph by the number of months, including parts of months, less 1, between the date of licence issue and its expiry date.
The monthly insurance contribution is the quotient obtained in dividing by 12:
(1)  the insurance contribution of $133.65 for issue of a restricted licence in 2009 (in 2008, the insurance contribution was $130.52);
(2)  the insurance contribution of $136.47 for issue of a restricted licence in 2011 (in 2010, the insurance contribution was $134.99); the annual insurance contribution is calculated by indexing on 1 January of the year of issue under sections 42 and 43, the amount of the annual insurance contribution for the preceding year, before adjustment under section 45.
The insurance contribution of $140.29 for issue of a restricted licence in 2012.

36. An amount is subtracted under the terms of the second and third paragraphs below from the insurance contribution payable by a person for the issuance of a restricted driver’s licence under section 76 of the Highway Safety Code (chapter C-24.2) if that person did not request the refund of part of the insurance contribution paid for the preceding licence although entitled to do so.
Where the preceding licence was a probationary licence, the insurance contribution calculated under the second paragraph of section 34 is subtracted from the amount calculated under section 35.
Where the preceding licence was a driver’s licence, the amount subtracted from that calculated according to section 35 is the insurance contributions paid for the number of months, excluding parts of months, between the date of the revocation of the driver’s licence and the payment due date of the amounts specified in the first paragraph of section 93.1 of the Highway Safety Code that would be payable if the licence had not been revoked.
This section does not apply when a period of more than 3 years has elapsed between revocation of a preceding probationary licence and issue of a restricted licence.

DIVISION V
REFUND OF INSURANCE CONTRIBUTIONS
37. A person whose licence is cancelled on his request or whose licence is revoked or suspended, except for a learner’s licence or a licence bearing only class 8, is entitled to a refund, on request, of part of the insurance contribution paid, as are his heirs and legatees, according to the rules for refund specified:
(1)  in sections 38 and 39, for a licence bearing:
(a)  one or more of classes 1 to 5 and one or more of classes 6A, 6B and 6C;
(b)  one or more of classes 6A, 6B and 6C;
(2)  in the Regulation respecting licences (O.C. 1421-91, 91-10-16), by replacing the monthly sums specified under those rules by the monthly insurance contribution applicable to the period for which the refund is to be made, for a licence bearing one or more of classes 1 to 5 and 8, without any of classes 6A, 6B and 6C, by adjusting the amount in accordance with section 45; the monthly insurance contribution is the quotient obtained in dividing by 12 the annual insurance contribution prescribed in section 12 or section 35, in the case of a restricted licence, before adjustment under section 45, according to the insurance contribution payment due year, the licence class(es) and the total number of demerit points used in calculating the insurance contribution paid.

38. The amount of refund of the insurance contribution paid for a licence bearing one or more of classes 1 to 5 and one or more of classes 6A, 6B and 6C is the amount obtained by adjusting, in accordance with section 45, the sum of insurance contributions as follows:
(1)  the product obtained by multiplying the monthly insurance contribution by the number of months, excluding parts of months, between the date of the event that triggers a refund and the expiry date of the period for which the holder is authorized to drive; the monthly insurance contribution is the quotient obtained in dividing by 12 the annual insurance contribution under section 12, before adjustment under section 45, according to the insurance contribution payment due year, the licence class(es) and the total number of demerit points used in calculating the insurance contribution paid;
(2)  the sum of insurance contributions for the number of months, excluding parts of months, between the date of the event that triggers a refund and the expiry date of the period for which the holder is authorized to drive; the insurance contribution for a month is calculated by applying the percentage determined under section 14 to an amount equivalent to the annual insurance contribution, set under section 12, before adjustment under section 45, for the holder of a licence bearing one or more of classes 6A, 6B or 6C with no demerit point on record, according to the insurance contribution payment due year.

39. The amount of refund of the insurance contribution paid for a licence bearing one or more of classes 6A, 6B and 6C but none of classes 1 to 5 is the amount obtained by adjusting, in accordance with section 45, the sum of insurance contributions for the number of months, excluding parts of months, between the date of the event that triggers a refund and the expiry date of the period during which the holder was authorized to drive. The insurance contribution for a month is calculated by applying the percentage determined under section 14 to an amount equivalent to the annual insurance contribution, set under section 12, before adjustment under section 45, according to the insurance contribution payment due year, the licence class(es) and the total number of demerit points used in calculating the insurance contribution paid.

40. Where the holder of a licence bearing one or more of classes 1 to 5 and one or more of classes 6A, 6B and 6C, except for a learner’s licence, who asks for cancellation of all classes other than classes 6A, 6B and 6C and the person whose licence classes other than classes 6A, 6B and 6C have been suspended, is entitled, on request, to a refund of part of the insurance contribution paid.
The amount of refund is the amount obtained by adjusting, in accordance with section 45, the product obtained by multiplying the monthly insurance contribution by the number of months, excluding parts of months, between the date of the event that triggers a refund and the expiry date of the period during which the holder was authorized to drive; the monthly insurance contribution is the quotient obtained in dividing by 12 the insurance contribution under section 12, before adjustment under section 45, for classes 1 to 5 and no demerit point on record, according to the insurance contribution payment due year.

41. Where the holder of a licence bearing one or more of classes 1 to 5 and one or more of classes 6A, 6B and 6C, except for a learner’s licence, who asks for cancellation of all classes other than classes 1 to 5 and the person whose licence classes other than classes 1 to 5 have been suspended, is entitled, on request, to a refund of part of the insurance contribution paid.
The amount of refund is the amount obtained by adjusting, in accordance with section 45, the sum of insurance contributions for the number of months, excluding parts of months, between the date of the event that triggers a refund and the expiry date of the period during which the holder was authorized to drive. The insurance contribution for a month is calculated by applying the percentage determined under section 14 to an amount equivalent to the annual insurance contribution, set under section 12, before adjustment under section 45, for classes 6A, 6B and 6C and no demerit point on record, according to the insurance contribution payment due year.

CHAPTER III
INDEXATION AND ADJUSTMENT OF INSURANCE CONTRIBUTIONS
42. Indexation of the insurance contribution is calculated by multiplying the amount to be indexed by the ratio between the current year’s Consumer Price Index (CPI) and the preceding year’s index.
Where the amount obtained by applying the first paragraph has more than 2 decimals, only the first 2 are retained and the second is increased by one unit if the third is greater than 4.

43. The CPI for a year is the yearly average computed on the basis of the monthly Consumer Price Index in Canada established by Statistics Canada for the 12 months preceding 1 September of the year preceding the year for which the Index is computed.
Where, on 1 September of a year, the data furnished by Statistics Canada are incomplete, the Société may use the data available at that time to establish the Consumer Price Index.
Where the yearly average computed on the basis of the monthly Consumer Price Index includes more than one decimal, only the first digit is retained and it is increased by one unit if the second digit is greater than 4.
Where the ratio between the Consumer Price Index for the current year and that for the preceding year includes more than 3 decimals, only the first 3 digits are retained and the third digit is increased by one unit if the fourth digit is greater than 4.

44. The Société shall publish the indexed insurance contributions each year in the Gazette officielle du Québec.
It shall also publish the result of adjustments to the insurance contribution exigible from the owner of a vehicle or the holder of a licence.

45. An amount exigible or refundable calculated under this Regulation is adjusted as follows:
(1)  the amount is multiplied by the equivalent of the tax rate applicable to the insurance contribution specified in section 512 of the Act respecting the Québec sales tax (chapter T-0.1);
(2)  the amount exigible or refundable calculated under this Regulation is added to the amount calculated under subparagraph 1;
(3)  the amount obtained by applying subparagraph 2 is increased to the nearest dollar if it includes a fraction of a dollar:
(a)  where the fraction of dollar is 50 cents or more, to the next highest dollar;
(b)  where the fraction of dollar is less than 50 cents, to the next lowest dollar;
(4)  the amount equivalent to the rate of tax on the insurance contribution prescribed under section 512 of the Act respecting the Québec sales tax is added to 1;
(5)  the amount obtained in accordance with subparagraph 3 is divided by the amount obtained in accordance with subparagraph 4.
Where the amount obtained by applying subparagraph 5 of the first paragraph has more than 2 decimals, only the first 2 are retained.
With respect to a passenger vehicle covered by section 98 or 99 of the Regulation respecting road vehicle registration (chapter C-24.2, r. 29), the rate under subparagraph 1 of the first paragraph is 0.

CHAPTER IV
TRANSITIONAL AND FINAL PROVISIONS
46. This Regulation replaces the Regulation respecting insurance contributions (O.C. 1422-91, 91-10-16).

47. Notwithstanding section 46, the Regulation respecting insurance contributions (O.C. 1422-91, 91-10-16), as it read on 30 September 2007, continues to apply:
(1)  to payment of the insurance contribution due before 1 January 2008 to retain the right to operate a road vehicle;
(2)  to payment of the insurance contribution upon registration of a road vehicle before 1 January 2008 and the right to put the vehicle into operation;
(3)  to payment of the insurance contribution exigible from a licence holder under sections 99 and 101 of the Regulation before 1 January 2008;
(4)  to payment of the insurance contribution upon issue of a licence before 1 January 2008.
Notwithstanding the first paragraph, this Regulation, in particular as regards the insurance contribution for 2008, applies in the following cases:
(1)  where a vehicle owner renounces the right to operate his vehicle within 3 months of the end of period during which operation of that vehicle is authorized, and he obtains the right to put the vehicle back into operation prior to that date, and before 1 January 2008;
(2)  where a licence holder cancels his licence within 3 months of the expiry date of the period during which the holder is authorized to drive and a new licence is issued to him prior to that date, and before 1 January 2008.

48. The insurance contribution exigible in 2008 from a driver’s licence holder born in an odd-numbered year is the amount obtained by adjusting in accordance with section 45 the difference between the insurance contribution determined under paragraph 1 and the insurance contribution determined under paragraph 2:
(1)  that prescribed in section 12, before adjustment under section 45, according to the total number of demerit points used in calculating the insurance contribution exigible in 2007, in accordance with the Regulation respecting insurance contributions (O.C. 1422-91, 91-10-16);
(2)  that paid for the period between his birthday in 2008 and his birthday in 2009, under the Regulation respecting insurance contributions.
The insurance contribution paid under the first paragraph is subject to a refund in accordance with the rules set out in sections 37 to 41 by substituting, in those sections, the insurance contribution paid under the first paragraph for the annual insurance contribution prescribed in section 12.

SCHEDULE II
(s. 2, par. 11)
(1) the Gouvernement du Québec or a public agency as defined in section 1 of the Act respecting land use planning and development (chapter A-19.1), except state-owned enterprises listed in Schedule I to the Regulation respecting road vehicle registration (chapter C-24.2, r. 29) and their subsidiaries;
(2) the Government of Canada;
(3) a foreign government insofar as it grants the same privilege to the Gouvernement du Québec;
(4) a school board;
(5) a hospital centre as defined in subparagraph h of section 1 of the Act respecting health services and social services for Cree Native persons (chapter S-5);
(6) a public institution which operates a general and specialized hospital, a psychiatric hospital or a residential and long-term care centre that is governed by the Act respecting health services and social services (chapter S-4.2);
(7) an institution exclusively devoted to charitable works that was established as a non-profit organization and is recognized as such under its constituting Act.
