Regulation respecting the circumstances in which a physician may obtain a permit to practise pharmacy
Pharmacy Act
(chapter P-10, s. 37, par. a).
DIVISION I
DEFINITIONS AND INTERPRETATION
1.01. The definitions contained in the Pharmacy Act (chapter P-10) shall apply to this Regulation unless the context indicates otherwise.

1.02. In this Regulation, unless the context indicates otherwise,
(a)  “municipality” means a municipality designated in the Décret concernant la révision des limites des régions administratives du Québec (chapter D-11, r. 1);
(b)  “permit” means a permit to practise pharmacy issued in accordance with paragraph a of section 37 of the Pharmacy Act (chapter P-10);
(c)  “region” means one of the regions within the meaning of the Décret concernant la révision des limites des régions administratives du Québec;
(d)  “territory” means a territory designated in the Décret concernant la révision des limites des régions administratives du Québec.

DIVISION II
GENERAL PROVISIONS
2.01. Notwithstanding any provision of this Regulation, no permit may be issued within a 20-mile radius (32.183 km) from the locality in which a pharmacist or a physician practises pharmacy.

2.02. For the purposes of section 2.01, the radius shall be calculated taking into account the regular means of land communication.

DIVISION III
CIRCUMSTANCES AND ISSUANCE OF PERMITS
3.01. A physician may, in the absence of a pharmacist or a physician practising pharmacy, obtain a permit in a municipality or in a territory of less than 3,000 inhabitants in the following regions:
(a)  Bas-Saint-Laurent–Gaspésie-Îles-de-la-Madeleine;
(b)  Saguenay–Lac-Saint-Jean;
(c)  Capitale-Nationale;
(d)  Mauricie–Centre-du-Québec;
(e)  Montérégie;
(f)  Outaouais; and
(g)  Abitibi-Témiscamingue.

3.02. In the Estrie region, a physician may, in the absence of a pharmacist or a physician practising pharmacy, obtain a permit in a municipality of less than 4,000 inhabitants.

3.03. In the Côte-Nord region, a physician may, in the absence of a pharmacist or a physician practising pharmacy, obtain a permit in a municipality or in a territory of less than 7,000 inhabitants.

3.04. In the Nord-du-Québec region, a physician may, in the absence of a pharmacist or a physician practising pharmacy, obtain a permit in a municipality or in a territory of less than 15,000 inhabitants.
