123.160. The enterprise registrar shall refuse to issue the appropriate certificate, if the article or document(1) does not contain the statements lawfully required by this Act;
(2) is not presented in the form and tenor prescribed by regulation of the Government and on the forms prescribed by the enterprise registrar;
(3) is not accompanied with the fee set out in the Act respecting the legal publicity of enterprises (chapter P-44.1) or the prescribed documents; or (4) provides for a name not in conformity with any of paragraphs 1 to 6 or paragraph 8 of section 9.1;
(5) (paragraph repealed).
However, if the article or document provides for a name reserved for the company in accordance with section 9.2, paragraph 8 of section 9.1 is not taken into account in respect of that name for the purpose of issuing the certificate.
