935. The motion must set out the facts which give rise to the application, and be accompanied by the necessary proof to establish them. It must be served upon all the known heirs or legatees, if they reside in Québec, and upon the testamentary executor, if any, and, moreover, be published in summary form, in the manner provided by article 139, with a notice of the date of its presentation, which must be not less than thirty days after the last publication.
