Section 651 Disposition versions

651. The judge may, upon the motion of a creditor holding an executory judgment, served on the debtor not less than five days before the day fixed for its presentation, order the debtor to appear in person to declare the amount of the work income which he earns as a self-employed worker or which is paid to him by an employer not resident in Québec and order him to deposit in the office of the court a portion of that income determined pursuant to the provisions of article 553.

The provisions of articles 641.1, 641.2 and 642 to 647 apply, adapted as required.

If the debtor does not appear in person to declare his work income, the provisions of article 284 apply to him.

If subsequently he does not regularly deposit the portion of his work income contemplated in the first paragraph, he is guilty of contempt of court.

651. If a debtor receives a salary or wages which cannot be seized, or any pay or allowance as a member of the Canadian forces not on active service, the judge or prothonotary may, upon motion of a creditor who has an executory judgment served upon the debtor five days at least before the day fixed for its presentation, order such debtor to appear in person and declare the amount of such remuneration, and order him to deposit such remuneration in the office of the court in the proportion fixed in paragraph 11 of article 553.

If the debtor does not appear in person to declare the amount of his remuneration, the provisions of article 284 apply to him.

If subsequently he does not regularly deposit the portion of his remuneration contemplated in the first paragraph, he is guilty of contempt of court.
