41. Section 40 shall be interpreted in such a way as to give to any cancellation by the Minister under the said section the effect of a complete forfeiture of all moneys paid by the purchaser, grantee, occupant or lessee, whether on account or in full payment of any sale, grant or location or any lease or occupation license, as well as any expenses or improvements laid out or made on the land or lands therein mentioned; but the Minister may, nevertheless, grant such compensation or indemnity as he may consider just and equitable.
The provisions of this section have applied and shall continue to apply in future to all cancellations of lots sold or otherwise granted prior to chapter 8 of the statutes of 1872, section 6.
