43. From the day the payment of the pension of a pensioner ceases by reason of death, or from the day of the death of a person who is 60 years of age or over, the spouse shall be entitled to receive as pension 60% of the pension the pensioner was receiving or the pension the person 60 years of age or over would have been entitled to receive.
The pension is payable to the spouse from the month following the death.

43. From the day the payment of the pension of a pensioner ceases by reason of death, or from the day of the death of a person who is 55 years of age or over, the spouse shall be entitled to receive as pension 60 % of the pension the pensioner was receiving or the pension the person 55 years of age or over would have been entitled to receive, taking into account, where applicable, the reduction provided for in section 27.
The pension is payable to the spouse from the month following the death.
