1. The right to use as public highways all roads, streets and public highways within any city or town in Québec is vested in their respective municipal corporations, except in so far as the right of property or other right in the land occupied by such highways has been expressly reserved by those previously interested therein when they originally ceded such land to serve as aforesaid, and except as to any concession road or cross road within the city or town where the persons in possession or those under whom they claim have laid out streets in such city or town without any compensation therefor in lieu of such concession or side road.
