Section 31 Disposition versions

31. A pension granted under subparagraph 3 of the first paragraph of section 2 shall cease to be paid on the first day of the month following the date on which the reason for which it was obtained ceases to apply.

However, an officer whose pension ceases to be paid pursuant to the first paragraph and who subsequently holds pensionable employment under the Government and Public Employees Retirement Plan shall participate in that plan notwithstanding section 54 or, as the case may be, in the Pension Plan of Certain Teachers or, if he holds pensionable employment under the Pension Plan of Peace Officers in Correctional Services, he shall participate in the latter plan.

31. An officer under 60 years of age who has retired by reason of physical or mental disability and who becomes able to render services, may be called upon by the Government to fill any public office the duties of which he is qualified by his previous service to discharge, and which is not inferior in rank and emoluments to the office he had left; provided always that the discharge of the duties of the office permits him to reside either at the seat of the Government or in the district where he last resided. In such a case, the pension ceases to be paid.

However, the officer is not a member of the plan provided for in this division, but is a member of the Government and Public Employees Retirement Plan if he holds pensionable employment under that plan.

31. An officer under sixty years of age who has retired by reason of physical or mental disability and who becomes able to render services, may be called upon by the Government to fill any public office the duties of which he is qualified by his previous service to discharge, and which is not inferior in rank and emoluments to the office he had left; provided always that the discharge of the duties of the office permits him to reside either at the seat of the Government or in the district where he last resided. In such a case, the pension ceases to be paid.

However, the officer does not contribute to the plan contemplated in this division, but he shall contribute to the Government and Public Employees Retirement Plan if he holds employment contemplated by that plan.

31. The benefits contemplated by sections 28 and 29 shall be paid in monthly instalments at the due date and shall continue as regards any person until the first day of the month next after the date on which such person ceases to be entitled thereto.

Nevertheless, the Government may order, on such conditions as it determines, that such benefits shall be paid in twenty-six instalments instead of twelve.

For the purposes of the said sections, the expression “dependent child” means any unmarried child, whatever be his filiation, who is substantially dependent upon the widow or widower for his subsistence, and the expression “educational institution” means every institution defined as such by a regulation made for such purpose by the Government. Such a regulation shall come into force on the date of its publication in the Gazette officielle du Québec or on such later date as is indicated therein.
