37. If, prior to the time when he may be granted a pension or a deferred pension, a teacher ceases to hold a position contemplated by this act, the sums deducted from his salary shall be reimbursed to him on his application.
If the teacher contemplated in the first paragraph is again employed by a body contemplated by this act within 180 days from the date his employment was terminated and if he has not been reimbursed the sums deducted from his salary, he may elect to be reimbursed the said sums or to be credited with the service he has accumulated.
If the teacher contemplated by the first paragraph has become or becomes a Member thereafter, he is entitled to a pension for the years during which he was a teacher, provided he acquires the right to a Member’s pension; such pension is deferred until he begins to receive a pension under the Legislature Act (chapter L-1) or the Act respecting the conditions of employment and the pension plan of the Members of the National Assembly (chapter C-52.1) provided he repays his contributions if they have been reimbursed to him.
