R-11 - Act respecting the Teachers Pension Plan

25. Every teacher is entitled to be credited for pension purposes with the years and parts of a year during which he contributed to a pension plan which applied before 1 January 1992 to a Member of the National Assembly and in respect of which he obtained a refund of his contributions, except if he has already exercised a right of redemption in respect of such years and parts of a year under a pension plan other than this plan.
The teacher shall pay to Retraite Québec, for each of such years and parts of a year, an amount equal to the amount obtained by applying the rate of contribution applicable under the plan at the time the plan becomes applicable to him to the indemnity he received as a Member or to the pensionable salary he receives or would have been entitled to receive in the school year at the time the plan becomes applicable to him, whichever is less.
A teacher who ceased to be a Member before 1 January 1958 may apply to have his years as a Member credited by paying an amount equal to 5% of the indemnity he received during each of such years.
The pension is based solely on the salary that he receives while participating in this plan.
25. Every teacher is entitled to be credited, for pension purposes, with the years and parts of a year during which he contributed to the system of retirement pensions established under the Legislature Act (chapter L-1) and in respect of which he obtained, before 1 January 1983, the withdrawal of his contributions under the said Act, except if he has already redeemed such years and parts of a year under section 29 of the Act respecting the conditions of employment and the pension plan of the Members of the National Assembly (chapter C-52.1).
The teacher shall pay to the Commission, for each of such years and parts of a year, an amount equal to the amount obtained by applying the rate of contribution applicable under the plan at the time the plan becomes applicable to him to the indemnity he received as a Member or to the pensionable salary he receives or would have been entitled to receive in the school year at the time the plan becomes applicable to him, whichever is less.

(1) he applies therefor within 24 months of the date he becomes a teacher within the meaning of the plan;
(2) he pays, for each of such years and parts of a year, an amount equal to the amount obtained by applying the rate of contribution applicable under the plan at the time the plan becomes applicable to him to the indemnity he received as a Member or to the pensionable salary he receives or would have been entitled to receive in the school year at the time the plan becomes applicable to him, whichever is less.
A teacher who ceased to be a Member before 1 January 1958 may, within the same period, apply to have his years as a Member credited by paying an amount equal to 5% of the indemnity he received during each of such years.
The pension is based solely on the salary that he receives while participating in this plan.
25. Every teacher may have years and parts of a year during which he was a Member of the National Assembly credited to him if
(1) he applies therefor within 24 months of coming under this plan;
(2) he has paid the contribution provided for in section 87 of the Legislature Act (chapter L-1);
(3) he is not entitled to a pension under that Act;
(4) he pays, for each of such years and parts of a year, an amount equal to the rate of contribution to this plan at the time he becomes qualified under this plan on the indemnity he received as a Member or the salary he receives or would have been entitled to receive in the school year at the time that he comes under this plan, whichever is less.
A teacher who ceased to be a Member before 1 January 1958 may, within the same period, apply to have his years as a Member credited by paying an amount equal to 5% of the indemnity he received during each of such years.
The pension is based solely on the salary that he receives while participating in this plan.
25. In the case of a teacher who dies after 1 January 1968 and before he reaches sixty-five years of age, the benefits contemplated in sections 22, 23 and 24 are computed by making the reduction contemplated for the case of retirement by reason of infirmity.
25. In the case of a teacher who dies after the 1st of January 1968 and before he reaches statutory old age, the benefits contemplated in sections 22, 23 and 24 shall be computed by making the reduction contemplated for the case of superannuation by reason of infirmity.
