61. (1) Whosoever, declared ineligible or disqualified from sitting or voting by section 55, 57, 58 or 59, so sits or votes, shall incur a penalty of one thousand dollars for every day he so sits or votes; and such sum may be recovered by any person suing therefor before a competent court.
(2) Every such suit, to be valid, must be brought within twelve months from the date on which such person so sat or voted contrary to the provisions of subsection 1.
(3) Whilst any such suit is pending no other such suit may be taken against the same defendant.
(4) The court wherein any such other suit is brought contrary to the intent and meaning of this section, shall, upon the defendant’s motion, stay the proceedings therein, if such first mentioned suit be effectively prosecuted without fraud.
(5) When any suit has been brought, and judgment rendered against the defendant, no proceedings may be had in any other such suit against the same person for any such offence committed before the time of service upon him of such judgment.
