44. To ensure optimal management of public infrastructures, the Government may, on the recommendation of the Chair of the Conseil du trésor, transfer ownership of an immovable, including any liabilities affecting the immovable, from one public body to another, subject to the terms and conditions it determines. Such a transfer has effect from the date the order is published in the Gazette officielle du Québec.
No transfer duties provided for in the Act respecting duties on transfers of immovables (chapter D-15.1) are payable by a public body for a transfer of property under this section. Within 90 days after an order of transfer is published, the public body that has become the owner of the immovable must file with the Land Registrar a statement that announces the transfer, refers to this section and the order, and includes the description of the immovable and the date of publication of the order in the Gazette officielle du Québec.
If the ownership of an immovable is transferred under this section, the public bodies concerned need not obtain the authorizations required by law, if applicable, to acquire or alienate the immovable.
