104.3. If the Tribunal prosecutes the president, a vice-president or another member of the Tribunal for an act done in the exercise of the functions of office and loses its case, it shall pay the person’s defence costs if a court of justice so decides.
If the Tribunal wins its case only in part, a court of justice may determine the amount of the defence costs it must pay.
