The dismissal of a suit for one of the grounds set forth in article 165 may be urged notwithstanding the failure to do so within the time limit; but if an exception made tardily results in the dismissal of the suit, the costs shall be the same as if the exception had been made within the time limit, unless the court otherwise orders.
