Upon an application by a defendant appealing the judgment by which he is imprisoned, a judge of the Superior Court of the judicial district where the appeal is brought shall release the defendant from custody on the conditions he determines, particularly the furnishing of a security, unless he believes that the defendant will abscond or will not keep the peace while awaiting judgment on the appeal; the judge ordering continuation of the detention of the defendant shall make any order to expedite the hearing of the appeal.
Prior notice of at least one clear day of the application for release from custody must be served on the prosecutor.
