178. The Minister may suspend or cancel a wood processing plant operating permit if the holder(1) fails to comply with this Title; or
(2) fails to file, with the regional agency for private forest development that has jurisdiction in the territory, the declaration required under section 163, gives false or misleading information in the declaration or fails to pay the required contribution to the agency concerned.
Before making such a decision, the Minister must notify the permit holder in writing as prescribed by section 5 of the Act respecting administrative justice (chapter J-3) and allow the permit holder at least 10 days to submit observations and remedy the failure. The suspension or cancellation of a permit has effect from the date on which the permit holder is notified of the Minister’s decision.
