41. Animal suspected of being diseased: Every animal suspected of being diseased or that is found to be injured following a visual examination carried out by an authorized person at the time of its arrival in an establishment must be directed to the examination and detention pen for examination by a veterinary surgeon appointed under section 55.9.17 of the Act before the auction.
Where the animal is found by a veterinary surgeon referred to in the first paragraph to be diseased, but not in a condition contemplated by section 40, it must be seized by the veterinary surgeon, sold as such and, after its sale, directed to the slaughterhouse where a release is granted depending on the results of the ante mortem or post mortem examination.
