41. Animal suspected of being diseased: Every animal suspected of being diseased or that is found to be injured following a visual examination carried out by an inspector at the time of its arrival in an establishment must be directed to the examination and detention pen for examination by a veterinary surgeon inspector before the auction.
Where the animal is found by the veterinary surgeon inspector to be diseased, but not in a condition contemplated by section 40, it must be seized by such inspector, sold as such and, after its sale, directed to the slaughterhouse where a release is granted depending on the results of the ante mortem or post mortem examination.
