11. The board may refuse to issue a licence if an applicant or one of the applicant’s officers, directors or employees working on the lottery scheme has been found guilty of or has pleaded guilty to(1) an offence against the Act respecting lotteries, publicity contests and amusement machines (chapter L-6) or a lottery scheme regulation or rules made under the Act with respect to a lottery scheme, within the last 3 years; (2) an offence punishable on summary conviction pertaining to gaming or betting, within the last 3 years; or
(3) an indictable offence involving gaming or betting or under Part IX or X of the Criminal Code (R.S.C. 1985, c. C-46), within the last 5 years.
