178. For the purposes of paragraph 1 of section 134 of the Individual and Family Assistance Act (chapter A-13.1.1), in the case of a financial assistance program established under Title II, if an amount is recoverable because of liquid assets, other than those in section 164, exceeding the assets excluded for the purpose of calculating the financial assistance, the claim is determined up to the highest amount of the excess liquid assets in a month within a period during which the independent adult or family was a recipient under the program.
A period consists of the consecutive months during which there are excess liquid assets and each period is considered separately to determine the recoverable amount. Any period of ineligibility under the program that does not exceed 3 months or any period during which an independent adult or a family is eligible to receive dental and pharmaceutical services pursuant to section 48 is not considered to be an interruption. In addition, liquid assets owned during a period of ineligibility are excluded from the calculation of excess liquid assets.
