Regulation respecting the manner of recording particulars required in the deed of transfer of an immovable

Act respecting duties on transfers of immovables

(chapter D-15.1, s. 24).

0.1. The obligations prescribed by this Regulation apply where an application for the registration of a transfer is made by means of the deed of transfer.

1. The particulars which the deed of transfer must contain pursuant to subparagraphs e to g of the first paragraph of section 9 of the Act respecting duties on transfers of immovables (chapter D-15.1), or pursuant to a regulation contemplated in subparagraph h of the first paragraph of the said section, must be consolidated at the end of the deed of transfer immediately before the closing of the deed under the heading: “Particulars required under section 9 of the Act respecting duties on transfers of immovables”.

The same shall apply:

(a)  to the particulars required under subparagraphs a to c of the first paragraph of the said section, where they are not entered in the appearance of the deed of transfer; and

(b)  to the particular required under subparagraph d of the first paragraph of the said section, where it is not entered in the description of the immovable contained in the deed of transfer.

2. The particulars required under subparagraph g of the first paragraph of the said section must indicate the section and, where applicable, the paragraph under which exemption from paying the transfer duty is referred to.
