Regulation respecting the leasing of land in the domain of the State for the building, operation and maintenance by private producers of hydroelectric power plants having a capacity of 25 MW or less

DIVISION I
SCOPE
1. This Regulation applies to the leasing of land and other immovable rights in the waters in the domain of the State or dry land required for the building, operation and maintenance by private producers of hydroelectric power plants having a capacity of 25 MW or less and related equipment or installations.

DIVISION II
ADMINISTRATION FEES AND LEASING COSTS
2. The fees payable for the leasing of a site in the domain of the State for the purposes provided for in section 1 are as follows:
(1)  $37 per hectare in the territories of cities and towns;
(2)  $31 per hectare in other municipal territories;
(3)  $25 per hectare in unorganized territories.

3. The annual rental for a site in the domain of the State may not be less than:
(1)  $1,500, if most of the site is located within the limits of a city or town;
(2)  $1,000, if most of the site is located within the limits of another municipal territory;
(3)  $500, if most of the site is located in unorganized territory.

4. On 31 March each year, the rental shall be adjusted and rounded to the nearest dollar according to the variation in the average cumulative consumer price index for the preceding year, based on the index established for Canada as a whole by Statistics Canada.

5. Administration fees of $400 shall be payable upon signing a lease under this Regulation.
Administration fees of $200 shall be payable upon applying for a transfer of a lease or for an amendment thereto.
Those fees shall be indexed in the manner prescribed in section 4.

6. The Minister of Natural Resources and Wildlife shall collect any sum due under this Regulation and shall act as the administrator of the leases to be entered into with private producers.

7. The fees for surveying and registration in the Register of the domain of the State shall be borne by the lessee.
