Pilot project to promote optimization of taxi transportation services requested in the Capitale-Nationale region using a mobile application

Act respecting transportation services by taxi

(chapter S-6.01, s. 89.1).

DIVISION I GENERAL

1. The Pilot Project to promote optimization of taxi transportation services requested in the Capitale-Nationale region using a mobile application (“Pilot Project”) is hereby authorized

(1)  to establish certain special rules that differ from those set out in the Act respecting transportation services by taxi (chapter S-6.01) and the regulations when taxi transportation services are requested in the Capitale-Nationale region using a mobile application;

(2)  to authorize the holders of a taxi owner’s permit or a taxi driver’s permit in that region using the mobile application of a sponsor referred to in the Schedule to this Pilot Project to benefit from the special rules set out in the Pilot Project; and

(3)  to collect information on the optimization results obtained for taxi transportation services requested using a mobile application, particularly as regards the number of trips made outside the home area and the average reduction in clientele wait times.

2. For the purposes of the Pilot Project,

“home area” means the taxi servicing area the taxi owner’s permit authorizes to be served; (agglomération d’appartenance)

“sponsor” means a holder of a taxi transportation service intermediary’s permit providing services to holders of a taxi owner’s permit or a taxi driver’s permit in the Capitale-Nationale region and whose mobile application is referred to in the Schedule to this Pilot Project. (promoteur)

3. So that a taxi owner or a taxi driver in the Capitale-Nationale region may benefit from the special rules set out in this Pilot Project, a sponsor must send an optimization project for taxi transportation services in that region to the Minister. An agreement between the sponsor and the Minister must be entered into and concern among other things information sharing, monitoring mechanisms and reporting requirements.

DIVISION II OPTIMIZATION OF TAXI TRANSPORTATION SERVICES

4. Despite section 6 of the Act respecting transportation services by taxi (chapter S-6.01), a taxi owner or taxi driver in the Capitale-Nationale region may make a trip outside the home area if

(1)  the customer requested the trip using a mobile application referred to in the Schedule to this Pilot Project; and

(2)  the start or destination of the trip is in any of the taxi servicing areas listed in the Schedule to this Pilot Project, in relation to the sponsor of the application and the taxi transportation service intermediaries associated with the sponsor for the use of the application; those intermediaries also being referred to in the Schedule to this Pilot Project.

5. The Minister of Transport is responsible for collecting information on the optimization of taxi transportation services requested using a mobile application in connection with this Pilot Project.

6. The holders of a taxi owner’s permit issued after the date of publication of this Pilot Project in the Gazette officielle du Québec cannot avail themselves of the special rules set out in the Pilot Project if their home area is Saint-Émile or Val-Bélair.

7. This Pilot Project comes into force on 30 December 2015. It terminates on the day that is two years after that date.
