The motion must be served on the person who refuses and on a reasonable person in the family of the person respecting whom the order is required or, if the latter has a tutor, curator or legal guardian, on such tutor, curator or guardian; service on the person who refuses must be made personally.
The judge may however dispense the applicant from serving the motion on the person respecting whom the order is required if the health or security of such person or another requires it or if there is urgency.
