109. If the pawnbroker refuse to acknowledge that such person has a right to the article pawned, upon payment of the amount due, the pawner may notify the pawnbroker to go before a justice of the peace, after a delay of not less than two days, and the latter shall hear the parties and their witnesses under oath, examine the documents produced, and award the articles claimed to the rightful owner. Such judgment shall be in writing, and shall give the right to keep or redeem the article, as the case may be.
All the above proceedings shall be without costs.
