282. A person residing in the Province of Ontario may be compelled to appear as a witness, if the judge or the prothonotary is satisfied that his presence is necessary and if there is not another action between the same parties and for the same cause pending in the Province of Ontario.
Such summons, however, can only be made upon a special order of the judge or the prothonotary written on the writ of subpoena which must be served in conformity with the law of Ontario, by a person of full age, who must make a return thereof under oath.
