16. (1)  No person shall drive a motor vehicle on a public highway unless he holds a driver’s permit of the appropriate class determined by regulation or a learner-driver’s permit.

(2)  A learner-driver’s permit shall be valid for a maximum period of six months and may be renewed on demand until the holder satisfies the requirements for obtaining a driver’s permit.

(3)  No person shall obtain or hold a driver’s permit unless:

(a)  he is at least sixteen years of age, has passed a driving course approved by the Régie in accordance with the regulations and has passed the examinations of competence set by the Régie in accordance with the regulations;

(b)  he is at least eighteen years of age, has held a learner-driver’s permit for a period of five months and has passed the examinations of competence set by the Régie in accordance with the regulations.

(4)  No person shall obtain or hold a learner-driver’s permit unless he is at least sixteen years of age.

The learner-driver’s permit issued to a person at least eighteen years of age authorizes such person to drive a motorcycle only for the purposes of a course in motorcycle driving approved by the Régie in accordance with the regulations.

(5)  The holder of a learner-driver’s permit must, when driving a motor vehicle other than a motorcycle, be accompanied by a person holding a driver’s permit of the appropriate class determined by regulation who is prepared to provide the learner-driver any assistance he may need.

(6)  The holder of a driver’s permit who assists a learner-driver must be seated beside him, be in condition to drive a motor vehicle, and be able to guide the learner in his driving and to intervene if necessary.

(7)  No permit shall be issued under this section to an unemancipated minor unless that minor’s father, mother or tutor consents to the issuance of such permit in a writing filed with the Régie.
