5.1. For the purposes of this Code, a person is deemed to have the care or control of a road vehicle when that person occupies the seat or position ordinarily occupied by the driver in circumstances in which it may be believed that there is a risk of the person setting the vehicle in motion.

5.1. For the purposes of sections 35, 36, 97, 98.1, 202.1.2 to 202.1.4, 202.2 to 202.2.1.2, 202.4, 202.5.1, 202.6.6 and 519.70, a person is deemed to have the care or control of a road vehicle when that person occupies the seat or position ordinarily occupied by the driver in circumstances in which it may be believed that there is a risk of the person setting the vehicle in motion.

Section 202.2.1, enacted by section 18 of chapter 29 of the statutes of 2002, will come into force on the date to be set by the Government (2002, c. 29, s. 81);
Section 202.5.1, enacted by section 29 of chapter 7 of the statutes of 2018, will come into force on the date to be set by the Government (2018, c. 7, s. 216).
