Whenever any person is accused of an offence against the provisions of this act, or of the charter, or of any by-law of the council, he may be summoned by a writ to appear before the said court, to answer the complaint, which shall be clearly and explicitly set forth in the writ; and such writ shall be served upon the defendant by any bailiff or constable; provided always that, in all cases of offences for the commission whereof a fine or imprisonment is imposed under any such law or by-law, it shall be lawful to proceed against the defendant either by a writ, as aforesaid, or by warrant of arrest issued by the municipal judge upon affidavit made before him.
