243. Every person wilfully obstructing any inspecting engineer in the execution of his duty shall, on conviction before a justice of the peace having jurisdiction in the place where the offence has been committed, be liable to a fine of not more than $40 for every such offence, and in default of payment of any fine so adjudged, immediately or within such time as the said justice of the peace appoints, the justice of the peace, or any other justice of the peace having jurisdiction in the place where the offender resides, may commit the offender to prison for any term of not more than three months; but such commitment shall cease on payment of the amount of the fine; and a return of every such penalty shall be made to the next ensuing sessions of the peace in the usual manner.
