189. Subject to remedies available under a collective agreement, or the provisions in lieu of a collective agreement, an employee referred to in section 181 who is dismissed may bring an appeal under section 33 of the Public Service Act (chapter F-3.1.1) if, on the date of the transfer to the Agency, the employee was a public servant with permanent tenure.
