47. Every person who, without authorization, either himself or through any other person, takes possession of and occupies any part of the public domain, shall be liable to a fine of not less than $1 nor more than $1 000 per day during which he is or has been wrongfully in possession of such public lands.
Such fine shall be recoverable, with costs, on action by the Crown, before any court of competent civil jurisdiction, and the court, in fixing the amount of the fine, must take into consideration the importance of the public land so occupied without right.
