40. If the Minister be satisfied that any purchaser, grantee, lessee or locatee of any public land, or any assignee claiming under or through him, has been guilty of any fraud or imposition, or has violated or neglected to comply with any of the conditions of the sale, grant, location, lease or occupation license, or if the sale, grant, location, lease or occupation license have been made or issued by mistake or contrary to the law or to the regulations, he may cancel such sale grant, location, lease or license, and resume the land therein mentioned, and dispose of it as if no sale, grant, location, lease or license thereof had ever been made.
The provisions of this section have applied and shall continue to apply to every such sale, grant, location, lease or occupation license made prior to chapter 11 of the statutes of 1869, section 20.
