3. This Act does not apply to(1) transportation described in the third paragraph of section 36 of the Transport Act (chapter T-12); (2) school transportation described in the Education Act (chapter I-13.3), the Education Act for Cree, Inuit and Naskapi Native Persons (chapter I-14), the Act respecting private education (chapter E-9.1) or the General and Vocational Colleges Act (chapter C-29) or transportation of students of an institution whose instructional program is the subject of an international agreement within the meaning of the Act respecting the Ministère des Relations internationales (chapter M-25.1.1); (3) transportation provided by a volunteer driver under the control of a humanitarian organization recognized by the Ministère de la Santé et des Services sociaux as part of one of its support programs, provided the total remuneration for such transportation is no more than a contribution to the expenses relating to the use of the automobile and the organization keeps a permanent register of all trips made;
(3.1) transportation provided by a volunteer driver under the control of a non-profit organization or legal person that transports persons who are intoxicated, provided that(a) the intoxicated person’s automobile is also driven to the destination;
(b) the service is not provided for pecuniary gain; and
(c) the organization or legal person keeps, at its head office, a permanent register of trips in which the pick-up point, information on the identity of the driver, the destination and the distance travelled are recorded;
(4) passenger transportation for baptisms, weddings and funerals as well as passenger transportation in antique automobiles over 30 years old, where the automobiles are given a mechanical inspection at least once a year; or
(5) transportation by ambulance or hearse.
