145. An offender becomes eligible for conditional release(1) after serving seven years of imprisonment, in the case of an offender sentenced to life imprisonment as a maximum sentence;
(2) after serving one half of the sentence of imprisonment imposed by the court or 10 years, whichever is shorter, in the case of a sentence of imprisonment of two years or more, where the circumstances set out in section 743.6 of the Criminal Code (Revised Statutes of Canada, 1985, chapter C-46) apply; or
(3) after serving one third of the sentence of imprisonment imposed by the court or seven years, whichever is shorter, in other cases.
Any time spent in custody between the day of arrest and the day on which the sentence was imposed shall be included in calculating the period referred to in subparagraph 1.
