349.9. Despite the provisions of the Health Insurance Act (chapter A-29), an agreement under section 349.3 may cover insured services that are not considered insured services when provided outside a facility maintained by an institution if the agency considers that access difficulties exist with respect to those services in the institutions in its area of jurisdiction. Furthermore, services provided by a physician under an agreement under section 349.3 are deemed, for the sole purposes of the physician’s remuneration, to be provided in a facility of the institution that referred the user to the associated medical clinic.
