40.1. The certificate is issued by the professional providing pregnancy care after he has evaluated, in accordance with protocols developed under section 48.1, that the working conditions of the pregnant worker may be physically dangerous to her unborn child, or to herself by reason of her pregnancy.
If the dangers and the associated working conditions are not identified by a protocol, the professional must, before issuing the certificate, consult with a physician in charge of health services in the establishment or, if there is no such physician, with the public health director of the region in which the establishment is situated, or the person designated by the public health director.
