96. If some or all of the Company’s activities are discontinued, an employee referred to in section 93 who had permanent tenure on the date of his or her transfer to the Company is placed on reserve in the public service with the same classification the employee had on the date of the transfer.
If some of the Company’s activities are discontinued, the employee continues to exercise his or her functions within the Company until the Chair of the Conseil du trésor is able to assign the employee a position in accordance with section 100 of the Public Service Act (chapter F-3.1.1). When assigning a position to an employee referred to in this section, the Chair of the Conseil du trésor determines the employee’s classification on the basis of the criteria set out in the first paragraph of section 95.
