Section 83
Disposition versions
83. The following persons are guilty of an offence and liable to a fine of $1,000 to $10,000 in the case of an individual and $3,000 to $60,000 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(2.1) every employer who does not keep all or part of a document for the time prescribed under paragraph a.1 of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.
83. The following persons are guilty of an offence and liable to a fine of $547 to $1,090 in the case of an individual and $2,186 to $6,825 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(2.1) every employer who does not keep all or part of a document for the time prescribed under paragraph a.1 of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $522 to $1,041 in the case of an individual and $2,087 to $6,517 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(2.1) every employer who does not keep all or part of a document for the time prescribed under paragraph a.1 of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $491 to $979 in the case of an individual and $1,963 to $6,129 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;

(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $479 to $956 in the case of an individual and $1,917 to $5,985 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;

(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $474 to $946 in the case of an individual and $1,897 to $5,923 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(2.1) every employer who does not keep all or part of a document for the time prescribed under paragraph a.1 of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $465 to $928 in the case of an individual and $1,861 to $5,811 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(2.1) every employer who does not keep all or part of a document for the time prescribed under paragraph a.1 of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $455 to $908 in the case of an individual and $1,821 to $5,685 in the case of any other person:

(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;

(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $442 to $883 in the case of an individual and $1,769 to $5,523 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $436 to $872 in the case of an individual and $1,747 to $5,454 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $429 to $858 in the case of an individual and $1,718 to $5,365 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $425 to $850 in the case of an individual and $1,702 to $5,315 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $417 to $834 in the case of an individual and $1,669 to $5,213 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $406 to $811 in the case of an individual and $1,623 to $5,071 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.

83. The following persons are guilty of an offence and liable to a fine of $400 to $800 in the case of an individual and $1,600 to $5,000 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.
83. The following persons are guilty of an offence and liable to a fine of $200 to $400 in the case of an individual and $800 to $1,600 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.
83. The following persons are guilty of an offence and liable to a fine of $400 in the case of an individual and $1 600 in the case of any other person:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.
83. The following persons are guilty of an offence and liable to the fines provided for in section 120:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.
83. The following persons are guilty of an offence and liable, in addition to costs, to the fines provided for in section 120:
(1) every employer or employee who refuses or neglects to furnish the Commission or any person authorized by it with the information provided for in subparagraph a of section 82;
(2) every employer who does not grant, on request, or delays to grant the Commission, or any person authorized by it, access to the register, the registration system or the pay-list provided for in subparagraph a of section 82;
(3) every person who does not grant, or delays to grant, the Commission, or any person authorized by it, access to the place where construction work is being done or to an establishment of an employer.
83. Every employer who does not keep the compulsory registration system, register or pay-list and every employer or employee who refuses or neglects to furnish the employees of the Commission with the information contemplated in subparagraph a of section 82, in the manner therein prescribed, or does not grant them on request, or delays to grant them, access to the place where the work is being done, to the register, to the registration system or to the pay-list or other documents, as provided in that paragraph, is guilty of an offence and liable, upon summary proceeding, in addition to costs, to a fine of $60 to $125; in the case of a subsequent offence within two years, he is liable, upon summary proceeding, in addition to costs, to a fine of $125 to $350.
83. Every employer who does not keep the compulsory registration system, register or pay-list and every employer or employee who refuses or neglects to furnish the employees of the board with the information contemplated in subparagraph a of section 82, in the manner therein prescribed, or does not grant them on request, or delays to grant them, access to the place where the work is being done, to the register, to the registration system or to the pay-list or other documents, as provided in that paragraph, is guilty of an offence and liable, upon summary proceeding, in addition to costs, to a fine of $60 to $125; in the case of a subsequent offence within two years, he is liable, upon summary proceeding, in addition to costs, to a fine of $125 to $350.
83. Every employer who does not keep the compulsory registration system, register or pay-list and every employer or employee who refuses or neglects to furnish the employees of the board with the information contemplated in subparagraph a of section 82, in the manner therein prescribed, or does not grant them on request, or delays to grant them, access to the place where the work is being done, to the register, to the registration system or to the pay-list or other documents, as provided in that paragraph, is guilty of an offence and liable, upon summary proceeding, in addition to costs, to a fine of $50 to $100; in the case of a subsequent offence within two years, he is liable, upon summary proceeding, in addition to costs, to a fine of $100 to $300.
