139. Despite the second paragraph of section 42, until 1 January 2016 or until any later date determined by the Minister of Finance, an insurer may provide a voluntary retirement savings plan to an employer through a group insurance representative only authorized to provide group insurance plans within the meaning of the Act respecting the distribution of financial products and services (chapter D-9.2) or through a representative in insurance of persons within the meaning of section 3 of that Act.

The first paragraph does not apply when a voluntary retirement savings plan is provided to an employer as a substitute for the voluntary retirement savings plan to which the employer is already subscribed.

In accordance with the first paragraph of section 139 of this Act, the Minister of Finance determines that up to 31 December 2021, an insurer may provide a voluntary retirement savings plan to an employer.
