43. No pension, except that granted to his spouse and children, or deferred annuity may be paid except in accordance with section 43.1 or 43.2, as the case may be, if the pensioner 65 years of age or over holds a position or employment contemplated by the Teachers Pension Plan or by the Government and Public Employees Retirement Plan, unless the rules provided in sections 60 to 70, 72 and 73 of the Act respecting the Government and Public Employees Retirement Plan (chapter R-10) and in section 61 of the Act respecting the Teachers Pension Plan (chapter R-11) apply.

No pension, except that granted under section 28 or 29, or deferred annuity may be paid if the pensioner 65 years of age or over holds a position or employment contemplated by the Teachers Pension Plan or by the Government and Public Employees Retirement Plan, unless the rules provided in sections 70.2 to 70.12, 70.14 and 70.15 of the Act respecting the Government and Public Employees Retirement Plan (chapter R-10) and in section 8.2 of the Act respecting the Teachers Pension Plan (chapter R-11) apply.

43. When the remuneration, whether annual or computed on an annual basis, is less than the annual amount of the pension, the beneficiary shall continue to receive, pursuant to the modalities of this act, the difference between the remuneration and the amount of the pension.
