R-12 - Act respecting the Civil Service Superannuation Plan

27. An officer who ceases to participate in the plan provided for in this division after 10 years of service and before becoming entitled to a pension is entitled to only a deferred annuity, unless

(1)  his years and parts of a year of service are transferred to the Teachers Pension Plan, the Government and Public Employees Retirement Plan or the Pension Plan of Certain Teachers;

(2)  he comes under a transferability agreement respecting the plan provided for in this division and entered into under the Act respecting the Government and Public Employees Retirement Plan (chapter R-10).

27. An officer who ceases to be a member of the plan contemplated in this section after 10 years of service and before becoming entitled to a pension is entitled to only a deferred annuity, unless

(1)  he transfers his years and parts of a year of service to the Teachers Pension Plan, the Government and Public Employees Retirement Plan or the Pension Plan of Certain Teachers;

(2)  he comes under a transferability agreement respecting the plan provided for in this division and entered into under the Act respecting the Government and Public Employees Retirement Plan (chapter R-10).

27. If an officer resigns or is dismissed or if his office is abolished after 10 years of service and before he qualifies for a pension, he is entitled to only a deferred annuity, unless

(1)  he transfers his years of service to the Teachers Pension Plan or the Government and Public Employees Pension Plan;

(2)  he comes under a transferability agreement respecting the plan provided for in this division and entered into under the Act respecting the Government and Public Employees Retirement Plan (chapter R-10).

27. On the death of a pensioner, the widow or widower or, where such is the case, the assigns of the pensioner are entitled to receive, until the first day of the month following such death, the pension which the pensioner would otherwise have received.

In this division, the word “widow” means the non-divorced wife of a deceased officer or employee.

If there is not a non-divorced wife, the word “widow” means the person who proves to the satisfaction of the Commission that for at least three years immediately preceding the death of that officer or employee:

(a)  she had been residing with him;

(b)  such public officer or employee had been publicly representing her as his consort; and

(c)  at the death of the public officer or employee neither she nor he was married to another person.

27. In the event of the death of such public officer or employee, his pension shall run to the first day of the month following, and his widow, or, failing her, his heirs, shall have a right to receive any payment then due.
