147. Subject to the second and third paragraphs, Retraite Québec may, after having given notice and in the manner prescribed by regulation, make up for any sum owing to it by a person out of any benefit or reimbursement of contributions it owes to that person.

Retraite Québec shall remit

(1)  any amount of pension or pension credit owed to Retraite Québec;

(2)  any excess reimbursement of contributions or actuarial value owed to Retraite Québec;

(3)  any overpayment owed to Retraite Québec by a spouse after the date of payment of the sums allotted to the spouse following the partition and assignment of benefits between spouses.

Retraite Québec shall remit any sum, other than the sums referred to in subparagraphs 1 to 3 of the second paragraph, owed to Retraite Québec in the cases and subject to the conditions determined by government regulation.

147. Subject to the second and third paragraphs, the Commission may, after having given notice and in the manner prescribed by regulation, make up for any sum owing to it by a person out of any benefit or reimbursement of contributions it owes to that person.

The Commission shall remit

(1)  any amount of pension or pension credit owed to the Commission;

(2)  any excess reimbursement of contributions or actuarial value owed to the Commission;

(3)  any overpayment owed to the Commission by a spouse after the date of payment of the sums allotted to the spouse following the partition and assignment of benefits between spouses.

The Commission shall remit any sum, other than the sums referred to in subparagraphs 1 to 3 of the second paragraph, owed to the Commission in the cases and subject to the conditions determined by government regulation.

(1)  any amount of pension or pension credit owed to the Commission where the amount was paid more than 36 months before the effective date of the adjustment of the pension or pension credit or before the date of the notice of claim sent by the Commission;

(2)  any excess reimbursement of contributions or actuarial value owed to the Commission where the excess amount was paid more than 36 months previously;

(3)  any overpayment owed to the Commission by a spouse after the date of payment of the sums allotted to the spouse following partition and assignment of benefits between spouses.

The Commission shall also remit, in the cases and subject to the conditions determined by regulation of the Government, any amount of pension or pension credit, or any excess reimbursement of contributions or actuarial value, owed to the Commission where the amount was paid before the expiry of the time limit specified in subparagraphs 1 and 2 of the second paragraph.

(3)  any overpayment owed to the Commission by a spouse after the date of payment of the sums allotted to the spouse following partition and assignment of benefits between spouses.

The Commission may, in accordance with the criteria and conditions determined by regulation of the Government, remit any sum owed to the Commission.

Except in cases of fraud or deceit, the Commission shall remit any amount of pension or pension credit owing to it which had been paid more than 48 months before the effective date of any adjustment of the pension or pension credit or before the date entered on the notice of claim from the Commission.

The Commission may, with the authorization of the Government, remit any other sum owing to it, if, in light of the circumstances, it considers the sum ought not to be recovered.

147. The administrative costs of arbitration shall be charged to the Commission, except costs of the witnesses, assessors or attorneys which shall be charged to the parties. The fees and costs of the arbitrator shall be charged to the Commission.
