70.2. The prior notice referred to in section 115.4.1 must be accompanied by a copy of any analysis, study or other technical report that the Minister has taken into account.

The Minister shall send a copy of the prior notice and order to the Minister of Health and Social Services and to the clerk-treasurer or clerk of the local municipality in whose territory the hazardous material is located.

70.2. At least 15 days before issuing an order, the Minister shall, as prescribed by section 5 of the Act respecting administrative justice (chapter J-3), notify the person having possession or custody of the hazardous material, indicating the grounds which appear to justify the order and the proposed effective date and stating that the person may present observations within the period indicated.

The prior notice shall be accompanied with a copy of any analysis or research report or any other technical report taken into account by the Minister.

The Minister shall transmit a copy of the prior notice to the Minister of Health and Social Services and to the secretary-treasurer or clerk of the municipality on whose territory the hazardous material is located.

70.2. Before issuing an order, the Minister shall serve on the person having possession or custody of the hazardous material a notice of at least 15 days indicating the grounds which appear to justify the order and the proposed effective date and stating that the person may make representations within the period indicated.

The notice shall be accompanied with a copy of any analysis or research report or any other technical report taken into account by the Minister.

The Minister shall transmit a copy of the notice to the Minister of Health and Social Services and to the secretary-treasurer or clerk of the municipality on whose territory the hazardous material is located.
