Every person who commits an offence is liable, in addition to the payment of the costs,(1) for a first offence, to a fine of not less than $200 nor more than $5 000 in the case of a natural person and, failing payment, to imprisonment for not more than three months and, in the case of an artificial person, to a fine of not less than $600 nor more than $30 000;
(2) for any subsequent offence within two years, to a fine of not less than $400 nor more than $10 000 in the case of a natural person and, failing payment, to imprisonment for not more than six months and, in the case of an artificial person, to a fine of not less than $1 200 nor more than $60 000.
