Section 58.4
Disposition versions
58.4. In the case of an application under the second or third paragraph of section 58, the commission must request the regional county municipality, the community and the certified association to transmit a recommendation to it within 45 days.
The recommendation must give reasons and must take into consideration the criteria set out in section 62.
The recommendation from the regional county municipality or the community must also take into consideration the objectives of the land use planning and development plan and the provisions of the complementary document or the metropolitan land use and development plan and the interim control measures, if any, and be submitted together with a statement as to whether the application is consistent with such documents.
58.4. In the case of an application under the second or third paragraph of section 58, the commission must request the regional county municipality or the community and the certified association to transmit a recommendation to it within 45 days. Where the application concerns a lot within the territory of a community, the commission shall, if the metropolitan land use and development plan is not in force, make the request for a recommendation to the regional county municipality whose territory includes the lot in respect of which the application is made and to the community whose territory also includes the lot. If the metropolitan plan is in force, the application shall be made only to the community.

The recommendation from the Commission de développement de la métropole must take into consideration the objectives of the metropolitan general land use plan and be submitted together with a statement as to whether the application is consistent with such documents.
