21.0.9. The appeal tribunal has jurisdiction to decide any question of law or fact.

Except in the case of an error of law or a material error of fact in the contested decision, the appeal tribunal may not reexamine the assessment of the application made by the commission on the basis of criteria the commission was required to consider.

An appeal from a decision suspends, by operation of law, any new application to obtain the same conclusions, until a decision is rendered on the appeal.

21.0.9. The appeal shall bear, in whole or in part, on the object of the initial application but cannot claim more than what had been applied for.

In appeal, proof may bear only on a fact having occurred prior to the decision or order appealed from, whether or not such fact has already been submitted as evidence.

The appeal from a decision suspends, by operation of law, any new application to obtain the same conclusions, until a decision is rendered on the appeal.

Subject to section 21.1, the decision of the appeal tribunal is final.
